Welcome to Propelus Manufacturing Private Limited (“Propelus”, “we”, “our”, or “us”). These Terms & Conditions govern your access to and use of our website, engineering consultations, mould tooling services, and manufacturing operations. By submitting a Purchase Order, requesting a quotation, or accessing our services, you agree to be bound by these terms.
1. Scope of Manufacturing Services
Propelus provides OEM/ODM plastic injection moulding, 2D/3D CAD product design, precision mould tool fabrication, SMT cleanroom assembly, compliance testing support, and export packaging services. All custom production runs are executed in accordance with approved engineering drawings and signed Purchase Orders.
2. Quotations, Pricing & Payment Terms
- Quotations: All commercial quotations remain valid for 30 calendar days from issue date unless specified otherwise.
- Tooling Deposit: Mould tooling orders require an initial deposit (typically 50%) prior to CAD approval and CNC machining, with balance due upon approval of T1 sample parts.
- Production Payment: Mass production orders are processed upon agreed commercial payment terms specified on official proforma invoices.
- Taxes & Duties: Prices exclude local taxes, customs tariffs, import duties, and freight insurance unless explicitly agreed under DDP Incoterms.
3. Client Intellectual Property & CAD Ownership
The client retains full, exclusive ownership of all proprietary CAD models, 2D drawings, product names, logos, and industrial designs submitted to Propelus. Custom mould tooling paid in full by the client remains client property and will be exclusively reserved for the client’s production orders.
4. Quality Standards & Tolerances
Manufacturing execution adheres strictly to agreed technical specifications:
- Dimensional tolerances for plastic injection moulded parts adhere to DIN 16742 / ISO 20457 standard tolerance grade 3 unless custom tolerances are specified in technical drawings.
- Production parts undergo ISO 9001 quality sampling before shipment. Sample T1 approval by the client constitutes authorization for mass production.
- Compliance with international toy safety standards (EN71, ASTM F963, BIS) is guaranteed when raw material grades specified by the client meet certified non-toxic standards.
5. Shipping, Delivery & Incoterms
All international shipments are governed by Incoterms 2020 (EXW, FOB, CIF, or DDP as agreed). Estimated lead times for tooling fabrication and mass production are provided in good faith. Propelus is not liable for transport delays caused by customs holdbacks, port congestion, or force majeure events.
6. Claims & Inspection Window
Clients must inspect shipments within 14 calendar days of delivery. Any claims regarding defective parts or quantity discrepancies must be submitted in writing with photographic and dimensional inspection evidence within this period. Valid claims for out-of-spec parts will be reworked, replaced, or credited upon verification.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Propelus shall not be liable for indirect, incidental, special, or consequential damages (including loss of profits, commercial business interruption, or market delays) arising out of manufacturing orders or website use.
8. Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka, India.
